As a special type of food, health food not only has the commonality of general food, but also is loved by specific groups of people because of its specific health care function, especially in modern society, with the enhancement of people's self-care awareness, health food is more favored by people. In the 90s of the 20th century, there was a dazzling array of health foods on the market, but due to the inability to keep up with the construction of laws and regulations, the development, production and sales of health foods lacked supervision and management, and were in a disorderly state. The health food market has seen a crisis in which it is difficult to distinguish between the real and the fake, and it is difficult to distinguish between good and bad, and it has gradually lost its due credibility in people's minds. Therefore, people of insight from all sides have spoken out to speed up the construction of the legal system and strengthen supervision and management, so as to bring China's health food to the track of healthy development. On February 28, 2009, the seventh meeting of the Standing Committee of the 11th National People's Congress passed the Food Safety Law of the People's Republic of China, marking a new milestone in the development of health food in China. It has enabled the entire health food industry to gradually embark on the track of healthy development.
(1) Examination and approval of health foods
According to the Food Safety Law of the People's Republic of China, the state strictly supervises foods that claim to have specific health functions, and the specific management measures are prescribed by the State Council. It can be seen from this that this law has strict provisions on the examination and approval of health foods. The Measures for the Administration of Health Foods specifically stipulate that all foods claiming to have health functions must be reviewed and confirmed by the Ministry of Health. The developer shall submit an application to the local provincial health administrative department, fill in the "Health Food Application Form" and submit the following information:
(1) Health food application form.
(2) Formula, production process and quality standards of health food.
(3) Toxicological safety evaluation report.
(4) Health function evaluation report.
(5) List of functional ingredients of health food, qualitative or quantitative test methods of functional ingredients, and stability test report. If the functional ingredients cannot be clarified under the existing technical conditions, the list of main raw materials related to health care functions in the food shall be submitted.
(6) Product samples and hygienic inspection reports.
(7) Label and instruction manual (sample for review).

In accordance with the "Technical Regulations for the Review of Health Food", the provincial health administrative department where the local health administration department sets up a review committee composed of experts in food hygiene, nutrition, toxicology, medicine and other related specialties to conduct a preliminary review of the above information, and after the preliminary review is approved, it is submitted to the Ministry of Health for approval, and the review committee of the Ministry of Health holds four review meetings every year, generally held in the last month of each quarter. According to the opinions of the review committee, the Ministry of Health will make a decision on whether to approve within 30 working days after the review, and if the review is qualified, the Ministry of Health will issue the applicant with the "Health Food Approval Certificate", and the approval number is "Wei Shi Jian Zi () No. ()". and permission to use the health food mark prescribed by the Ministry of Health. If the applicant applies for permission to import health food, the application should be submitted to the Ministry of Health by the importer or agent.
(2) Production, supervision and management of health food
1. Production of health foodBefore the production of health food, the food production enterprise must apply to the local provincial health administrative department, and after approval, and the applicant's health license can only be produced after adding the licensed item of "xx health food". Health food producers must organize production in accordance with the approved content, and shall not change the product formula, production process, enterprise product quality standards, and product names, labels, instructions, etc.
2. Supervision and management of health food: The health administrative departments at all levels shall supervise and manage the health food, and the Ministry of Health shall revoke the "health food approval certificate" for those who fail to pass the examination or do not accept the re-examination
